1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from GS Explore International LLC to consumers (§ 13 BGB).

3. Offer and conclusion of contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. All offers are valid "while stocks last," unless otherwise stated with the product. Errors excepted.

3.2 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Submit Order" button, you are placing a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order, along with its acceptance, will be sent immediately after submission via automated email. The purchase contract is concluded upon receipt of this email confirmation.

4. Contract text

The contract text is stored on our internal systems. You can view the terms and conditions at any time on this page. The order details will be sent to you by email. Acceptance of the terms and conditions is expressly required before placing the order. For security reasons, the contract text is no longer accessible online after the order has been completed.

5. Right of withdrawal

Consumers (§ 13 BGB) have a statutory right of withdrawal.

You may revoke your contractual declaration within one month without giving reasons in written form (e.g., letter, fax, email) or – if the goods are delivered to you before the deadline – also by returning the goods. The period begins upon receipt of this instruction in written form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) and our obligations pursuant to § 312g paragraph 1 sentence 1 of the German Civil Code (BGB) in conjunction with Article 246 § 3 of the EGBGB. Timely dispatch of the revocation notice or the goods is sufficient to meet the revocation deadline.

Consequences of revocation

In the event of a valid cancellation, both parties are obligated to return any goods or services received and to surrender any benefits derived from them (e.g., interest). If you are unable to return the received goods or services, or any benefits derived from them (e.g., advantages of use), either in whole or in part, or only in a deteriorated condition, you must compensate us accordingly. You are only required to compensate us for deterioration of the goods or benefits derived from them if the deterioration or benefits are due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning. "Ascertaining the nature, characteristics, and functioning" means testing and trying out the respective goods as is possible and customary in a retail store. Goods that can be shipped by parcel post must be returned at our risk. You are responsible for the regular return shipping costs if the delivered goods match your order and if the price of the item being returned does not exceed €40, or if, in the case of a higher-priced item, you have not yet paid the full purchase price or a contractually agreed partial payment at the time of your cancellation. Otherwise, the return is free of charge for you. Items that cannot be shipped by parcel post will be collected from you. Refunds must be processed within 30 days. This period begins for you when you send your cancellation notice or return the item, and for us when we receive it.

6. Prices and shipping costs

6.1 The prices stated on the product pages include statutory VAT and other price components.

6.2 Shipping costs depend on the quantity of goods ordered and the shipping method, and will be clearly communicated to you before you submit your binding order. You can find an overview on the Shipping page.

6.3 Cost-Bearing Agreement : If you exercise your right of withdrawal, you are responsible for the regular costs of return shipping if the delivered goods correspond to the order and if the price of the item to be returned does not exceed €40, or if, in the case of a higher price, you have not yet paid the purchase price or a contractually agreed partial payment at the time of withdrawal. Otherwise, the return is free of charge for you.

7th delivery

7.1 Delivery is generally only available within Europe. Additional costs apply for deliveries to other countries.

7.2 Delivery within Germany typically takes three to five business days. Any differing delivery times will be indicated on the respective product page. Delivery within Europe generally takes seven to ten business days. Delivery times to other countries depend on the destination country and cannot be predicted by us.

8. Payment

8.1 You have the following payment options: prepayment or cash on delivery; as well as payment by invoice, direct debit or credit card with Paypal.

8.2 If you select prepayment as your payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

8.3 You are only entitled to set-off if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged by us in writing.

8.4 You may only exercise a right of retention to the extent that the claims arise from the same contractual relationship.

9. Retention of title

The goods remain our property until full payment is received.

10. Warranty

The warranty is provided in accordance with statutory regulations.

11. Applicable Law

11.1 The law of the Federal Republic of Germany shall apply.

11.2 The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

11.3 The contract shall be concluded exclusively in German.

11.4 The place of jurisdiction for both parties is Herbolzheim.
